A gelato maker won two of three complaints against C&C Retail Limited t/a Gino’s Gelato, receiving €440 for missed work breaks and €880 for not receiving written terms of employment. The Workplace Relations Commission decision was dated 10 March 2023. Andrea Baldacchino said he had not been given proper breaks, statutory minimum notice or a copy of his employment terms. The company denied the claims, saying he controlled his breaks, had received a week’s pay in lieu of notice and that his terms were sent to his outlet. The adjudication officer found Baldacchino was denied at least four breaks and awarded €440, equivalent to one week’s salary. The minimum-notice complaint was not well founded because he received a week’s pay in lieu of notice. The terms complaint was well founded: the officer found Baldacchino had not received the statement and that the document produced was unsigned, and awarded €880, equivalent to two weeks’ remuneration.
