WRC lacks jurisdiction over religious discrimination complaint at pub

The Workplace Relations Commission could not decide Declan O'Malley's complaint alleging religious discrimination at Harty's Bar. Its decision, dated 2 October 2023, said the merits were not decided because the alleged interactions took place on licensed premises.

O'Malley said he was asked for a vaccine certificate and offered outdoor service, and that customers later abused him. Eamonn Harty, trading as Harty's Bar, said he was not present at the first interaction and had not refused service at the second. Under the Intoxicating Liquor Act 2003, claims of prohibited conduct on licensed premises may be brought in the District Court.
