The Workplace Relations Commission found Brian Scully’s complaint well-founded and ordered Top Security to pay €1,056 for an annual-leave pay shortfall, plus €2,500 compensation. The decision was dated 3 February 2023. Scully said his holiday pay had been calculated using 40 hours for each week of leave, although he normally worked 48-hour weeks. Top Security accepted that €1,056 was owed for the relevant period. The adjudication officer said compensation was appropriate because Scully had to bring proceedings a second time to secure his entitlement.
