WRC finds Kevin Stapleton’s unfair dismissal complaint was out of time

The Workplace Relations Commission found it had no jurisdiction to investigate Kevin Stapleton’s unfair dismissal complaint against Acushla Ltd because it was out of time; the merits were not decided. The decision was dated 20 March 2023. Stapleton said his employment ended on 12 March 2021, the date he said Acushla registered with Revenue. The company argued he resigned with immediate effect on 13 February 2021. The adjudication officer accepted 13 February as the dismissal date. The complaint, received on 24 February 2022, was more than 12 months later. Stapleton also said delays in receiving employment records contributed to his late filing; among the records he listed was documentation about an alleged 5% wage reduction.
