WRC rejects Tomas Murphy’s constructive dismissal claim

The Workplace Relations Commission found that Tomas Murphy was not constructively dismissed, ruling that his resignation was voluntary. The decision was dated 6 March 2023. Murphy, an HGV driver, said he was forced to resign after disciplinary action that included a request to repay truck damage. The adjudication officer identified procedural unfairness in the disciplinary process, but found Murphy had decided to leave, did not pursue options to return or raise a grievance, and found new work about three weeks later. The respondent did not deduct or recover any money for the damage.
