The Workplace Relations Commission (WRC) awarded Abdulah Aljaber €15,000 after finding that Dawn Meats Group Unlimited Company discriminated against him on the disability ground. Adjudication Officer Gaye Cunningham issued the decision dated 5 July 2024.
Aljaber said he injured his back and asked for lighter duties before the company dismissed him. Dawn Meats said he had been absent for months, no light duties were available and his contract was terminated after concerns during his probation.
The WRC found the dismissal was linked to Aljaber’s disability. It also found the company had not investigated whether he could continue in another role, sought medical advice or discussed possible adjustments with him. The decision says employers must consider reasonable measures that could enable a disabled employee to continue working, unless those measures would impose a disproportionate burden.
