The Workplace Relations Commission found that Gerard Mc Veigh was not unfairly dismissed by Dunnes Stores and rejected his minimum notice complaint. It dated its decision 17 August 2022. Mc Veigh worked as a general assistant. His dismissal followed an investigation into his arrest and court appearance over an alleged offence. He argued the incident was unrelated to work and that the investigation and procedures were unfair. Dunnes Stores said there were substantial grounds for dismissal and that he had not cooperated with its investigation. The officer found that Mc Veigh had several opportunities to explain his account but gave no information beyond confirming his arrest and the reported court case. The officer concluded that dismissal for gross misconduct fell within the range of reasonable responses and that substantial grounds justified it. Both complaints were found not well founded.
