A worker’s complaint over his dismissal during probation failed at the WRC, while his separate wages complaint was withdrawn. In a decision dated 27 September 2022, the WRC found the employer had dismissed him for poor performance after warning him. The worker said he was dismissed without a chance to defend himself and believed it followed a question about pay parity. The employer said there had been complaints about his work pace and that he had been warned. The adjudication officer accepted the employer’s account, finding that the worker was dismissed in his second month of employment and that the disputed three- or six-month probation period made no difference. The worker’s complaint under the Industrial Relations Acts failed; his Payment of Wages Act complaint was withdrawn.
