The Workplace Relations Commission found that Pedro Kodama Gualda was not discriminated against on grounds of race by Red Leaf Entertainment Limited trading as J.T.Pims. The decision was dated 27 October 2022.
Gualda said a manager made disparaging remarks about Spanish and Italian people and directed them at him. He started work as a bartender in July 2021 and left after 15 weeks. The company rejected that discrimination had occurred.
The adjudication officer found Gualda had not proved the primary facts needed to raise a presumption of discrimination. The officer also found no less favourable treatment on grounds of race and said any bullying or harassment had not been proved to arise from race. The complaint failed.
