The Workplace Relations Commission awarded Richard Fox €1,500 after finding Apoca Parking Ireland Limited failed to provide statutory rest breaks. The decision was dated 25 September 2023.

Fox said he routinely worked 12-hour shifts without set breaks at a shopping centre car park in County Louth. The adjudicator accepted his uncontested evidence and noted that Apoca had not provided records showing compliance with rest-break requirements.

The WRC also found that the car park service transferred to Pillardale Limited on 1 September 2021, with two of the three assigned workers continuing in the service. It concluded that liability for Fox’s dismissal lay with Pillardale, so his unfair dismissal complaint against Apoca was not well founded. His complaints about redundancy, notice, and holiday pay, along with several other claims, were also not upheld or were not pursued.
