The Workplace Relations Commission awarded Ken Moore €12,000 compensation after finding he was unfairly dismissed from his general manager role at Waterford Castle Hotel and Golf Resort. The decision, dated 17 May 2023, also ordered the hotel to pay €2,500 for 11 days of accrued annual leave.
Moore said his redundancy was not genuine and that he had not been paid for annual leave accrued during the final six months of his employment. The hotel said restructuring during the pandemic had made the general manager role redundant.
The adjudicator found the hotel had not consulted Moore meaningfully, sufficiently considered alternatives or given him an opportunity to appeal his selection. The WRC also found annual leave accrued from January to July 2021 had not been accounted for. Both complaints were upheld.
