The Workplace Relations Commission found that Mowlam Healthcare did not discriminate against Helen O'Reilly during the period it could consider, and found her complaint not well founded. The decision was dated 18 April 2023. O'Reilly said her mandatory retirement in December 2020 was age discrimination. She referred the complaint about ten months after her employment ended. Mowlam Healthcare argued it was outside the six-month time limit; O'Reilly argued that later correspondence, alleged misrepresentation and reasonable cause justified considering it. The WRC found no further act of discrimination during the period from 15 April to 15 October 2021. It found the dismissal fell outside that period, so the merits of the earlier allegation were not decided.
