The Workplace Relations Commission found Oana Morosanu’s complaints of disability discrimination and a change to her employment terms were not well founded. Four other complaints were withdrawn at the hearing: public-holiday pay, a trade dispute, redundancy and minimum notice. Morosanu, who worked in administration in the Hilton Dublin Hotel’s Events section, said the hotel’s requests that she work in food and beverage or reception roles conflicted with her back condition. She also alleged the employer threatened to report her to Revenue or Social Welfare. The hotel said the requests were not demands and that her Events role was offered back before she resigned. The officer found the hotel had offered her the Events role she said she could do and that asking her to consider reception work did not meet the threshold for harassment. The terms complaint also failed: the officer found no evidence that her employment terms had changed. The decision was dated 2 August 2022.
