WRC recommends €3,000 for worker after company failed to investigate bullying complaints

The WRC found that a development company failed to investigate a worker’s bullying and harassment complaints in a timely manner and recommended €3,000 compensation. The recommendation was dated 7 October 2022.

The worker said the company failed to apply its Dignity at Work procedure to complaints made in March 2020 and March 2021. The company said it arranged mediation and later hired an external HR consultant, but argued that the worker refused mediation and referred the dispute to the WRC prematurely.

The adjudication officer found that the worker was entitled to have her complaints investigated within a reasonable time. The officer recommended that the company manage complaints under its own procedure and the Code of Practice, that the parties restart the process, and that the company pay €3,000. A separate Payment of Wages complaint was withdrawn.
