WRC recommends €375 payment to worker for handheld device use

The WRC recommended that an employer pay a worker €375 for using a handheld data device, under an agreement made in February 2018. The recommendation was dated 7 October 2022. The worker said changes to the contractor’s eligibility process had not been explained, leaving a payment for work completed unpaid. The employer supported the claim, saying the worker met the criteria, but the contractor had rejected its business case for the payment. The adjudication officer found that the parties had agreed to the payment and that the agreement should have been honoured. The recommendation said the employer should pay €375 within a week, send the recommendation to the contractor and seek a refund. It was specific to this worker and was not to be used as a precedent.
