WRC finds Securitas responded properly to racial harassment of security officer

By Donal Gilhooly

Historic decision · Decision date:

Place: no local area assigned from the source.

The Workplace Relations Commission found that a colleague’s racial slur against security officer Alan Casey breached the Employment Equality Act, but ruled that Securitas Security Services Ireland had responded properly and the complaint against it was not well founded.

Casey said a colleague used racial abuse during an argument at work. Securitas investigated, accepted that Casey had experienced verbal harassment, and took disciplinary action against the colleague. The WRC said Casey’s position was largely vindicated, although he had made some contribution to the incident.

The WRC accepted that the employer had taken the reasonably practicable steps required by law to prevent harassment and had acted fairly and proportionately. Complaints CA-00045637-002 and CA-00045637-003 were withdrawn at the hearing.

The decision was dated 4 January 2023.
