The Workplace Relations Commission awarded Dariusz Kowalski €3,500 after finding his dismissal by Nvd Limited. was unfair and was not a genuine redundancy. Adjudication officer Máire Mulcahy dated the decision 8 September 2025.
Kowalski had worked as a heavy goods vehicle driver transporting cars. He argued that the work continued after he refused a new contract; Nvd Limited. said his role was redundant and that it had offered suitable alternative employment. The adjudicator found the need for truck drivers had not diminished and Kowalski had been replaced. His separate working-time complaint was withdrawn.
