The Workplace Relations Commission ordered Sergejs Afanasjevs Raduga to pay Jevgenija Katkova €3,600 in compensation for an annual-leave breach, in a decision dated 1 November 2023. It also ordered €1,200 for unpaid leave, €900 over public holidays and €300 for Sunday work.
Katkova worked as a shop assistant for Raduga from about 9 April 2007 until her employment ended no later than 3 January 2021. She told the WRC she had not received paid annual leave and had worked long hours. Raduga did not attend the hearing, where Katkova gave evidence under affirmation.
The WRC found she was entitled to four weeks’ paid leave for the relevant leave year, based on a weekly salary of €300. It upheld her complaints over public-holiday pay and Sunday work. Her breaks complaint was not well founded because she was no longer working in the period covered by that complaint.
The commission found it had no jurisdiction over her constructive-dismissal complaint because it was lodged outside the time limit. It also found it lacked jurisdiction over her maximum-hours, weekly-rest and written-terms complaints. Katkova withdrew her Payment of Wages complaint.
