The WRC found that Mohamed Ahmed Moustafa Hamouda’s six complaints against D&N Kirwin were brought outside the time limit and were not well founded; the merits were not decided. The complaints concerned alleged unpaid annual leave and public holidays, inadequate rest and breaks, excessive working hours and misleading information about his employment terms. Hamouda worked as a fisher on the company’s vessel, the Courageous, from 2018 until December 2020. The adjudication officer refused to extend the time for filing the complaints, finding that Hamouda had not shown reasonable cause to explain and justify the delay. She noted that he had received information in his own language about his rights and how to complain, and had left the job before submitting his complaints in July 2021.
