The Workplace Relations Commission found Brian Delahunty was unfairly dismissed by M&M Products Limited and awarded him €23,654 in compensation. The decision was dated 27 January 2023.
The case centred on whether Mr Delahunty resigned or was dismissed during a series of exchanges in March 2021. He said the company’s director told him to leave and return his keys; the company said he resigned and abandoned his job. The adjudication officer found the company dismissed him, most clearly when the director said on 30 March that he would not be returning.
The WRC found there had been no process or substantive grounds to justify the dismissal. It also found Mr Delahunty had not contributed to it. He had quickly found new work, first as a general operative and then as a plant manager, and was awarded compensation for his losses.
