The WRC found Christian Goulart Mcnerney was not discriminated against by the Dept Of The Environment, Climate And Communication after rejecting his complaints about reasonable accommodation and harassment. The decision was dated 9 August 2022.
Mcnerney said the department failed to accommodate his disability when it asked him to return from Brussels to Dublin and that he was harassed by repeated requests to attend the office. The department said it had permitted him to work from Brussels on compassionate grounds and expected staff to attend when required.
The officer found no prima facie case on reasonable accommodation, noting the department was not on notice of his disability when it asked him to attend the office on 1 December 2020 and medical evidence came later. On harassment, the officer noted that all staff in the division were asked to attend and found no evidence the alleged conduct was related to disability.
