The Workplace Relations Commission found that Parkside Kingscourt Limited did not engage in prohibited conduct after Liam Neville alleged disability discrimination over a face-mask dispute at its supermarket. The decision was dated 13 February 2023.
Neville said he had anxiety and asthma and was exempt from wearing a mask. He alleged the store owner threatened to call Gardaí and told staff not to serve him. The company disputed that account, saying he had not told the owner that a disability prevented him from wearing a mask and that he was not refused service.
The adjudication officer accepted that Neville had anxiety and asthma but found the owner could not have known about the conditions unless Neville told him. The officer did not find credible the claim that staff were told not to serve him, noting Neville completed his shopping. The complaint was not well founded because he had not established a prima facie case of disability discrimination.
