The Workplace Relations Commission found that CBRE GWS (Ireland) Limited breached Aideen O’Regan’s transferred redundancy terms and ordered it to pay her €78,104. In a decision dated 4 January 2023, the WRC also found that her dismissal was a genuine redundancy and that she was not unfairly dismissed.

O’Regan had transferred to CBRE from Thompson Reuters and said her terms entitled her to six weeks’ pay per year of service, without a cap. CBRE disputed that the enhanced entitlement continued, relying on a five-year limit in material negotiated for UK employees. The WRC found that limit did not apply to O’Regan and that her transferred terms included the enhanced package. CBRE had paid her statutory redundancy of €31,620.

The WRC found that reduced client demand led to a genuine redundancy. O’Regan was the only person in her role, and the WRC found she was not unfairly selected. It rejected her unfair dismissal complaint and awarded the maximum two years’ pay compensation for the breach of her transferred terms.
