The Workplace Relations Commission found two complaints by Samuel Long against Flutter Entertainment Plc not well founded in a decision dated 1 September 2023. The claims concerned his dismissal from his job as a betting shop manager and alleged missed rest breaks. Flutter said Long accepted bets for a customer who did not always pay at the time, contrary to company policy. Long argued the practice was established, that the customer later paid and that Flutter suffered no loss. The WRC found the practice breached company procedures and that Long’s belief it was standard practice was not credible for a manager. The WRC said the disciplinary and appeal processes were substantially fair and that dismissal was a reasonable response to serious misconduct that undermined trust in a manager handling cash. It found both complaints not well founded. The decision also says the WRC lacked jurisdiction to investigate the working-hours complaint based on older records, but the operative decision classifies it as not well founded. A complaint found not well founded is one the adjudicator did not uphold. No compensation was awarded.
