The Workplace Relations Commission found that Shane Bennett was not discriminated against when Westrock selected him for redundancy. The decision, dated 12 December 2022, said he had not established an initial case of discrimination.
Bennett, a Quality Supervisor, alleged that his dismissal was discriminatory. Westrock said it had selected him fairly after losing two significant customers and reorganising its business.
The adjudicator considered the employer’s adjustments to its scoring process, including removing absence linked to Bennett’s accident. The WRC found no evidence that the scoring matrix had been applied other than objectively and fairly, and said Westrock had taken his disability into account.
