The Workplace Relations Commission recommended total compensation of €10,000 for a worker after finding flaws in a public service recruitment competition and an unacceptable delay in an internal review. The recommendation was dated 7 December 2022.
The worker said driving aptitude and fitness were assessed on paper, although these were not listed in the advertised requirements. The employer said it used a consistent scoring process and argued the dispute had wider implications for other personnel.
The adjudication officer found the worker’s marks for driving and fitness could not be understood without practical assessments. She also found the internal review took an unacceptable length of time and caused unnecessary stress. She recommended €5,000 for the shortlisting flaws and €5,000 for the delay.
