The Workplace Relations Commission recommended €10,000 compensation for a worker after finding flaws in a public service promotion competition and a lengthy internal review. Adjudication Officer Marie Flynn dated the recommendation 7 December 2022.
The worker challenged being assessed on driving aptitude and fitness through paper scoring without practical tests. The employer said the same scoring system was applied to all candidates and argued the dispute could affect a wider group. The Commission for Public Service Appointments found that general scoring was fair, but driving and fitness were assessed without practical tests.
Flynn found that the driving and fitness criteria could not properly be assessed on paper. She also found that the delay in responding to the worker’s review caused unnecessary stress. The WRC recommended €5,000 for the shortlisting flaws and €5,000 for the delay.
