The Workplace Relations Commission recommended €10,000 compensation for a worker after finding flaws in a driver-role shortlisting process and an excessive delay in an internal review. The recommendation was dated 7 December 2022 under section 13 of the Industrial Relations Act 1969.
The worker said driving aptitude and fitness had been scored from an application form without practical assessments, and that the marks did not reflect their skills and experience. The employer said the same application-based process was applied to all candidates and allowing the worker into a closed competition could be unfair to others.
The Commission for Public Service Appointments found the general scoring system was fairly applied, but that driving and fitness were not appropriately assessed and the review process breached its code. The WRC adjudicator said the worker’s marks in those areas could not be understood without practical assessment, and found the review took an unacceptable length of time and caused unnecessary stress. The WRC recommended €5,000 for the shortlisting flaws and €5,000 for the delay.
