WRC rejects disability discrimination complaint over mask request at shopping centre

The Workplace Relations Commission found Karl Byrne was not discriminated against on grounds of disability after a security officer asked him to wear a face mask at Stephen’s Green shopping centre. The decision was dated 16 May 2023.

Byrne said his disability exempted him from wearing a mask and objected to being asked for medical evidence. Bidvest Noonan (ROI) Limited denied discrimination, saying it was not aware of his disability when the officer asked him to wear a mask. The officer said he had asked about 30 people to wear masks that day.

The adjudication officer found no evidence that a person without a disability, or with a different disability, was treated more favourably. The officer also found that the respondent was not on notice of Byrne’s disability and had not failed to provide reasonable accommodation. The complaint under the Equal Status Acts was found not well founded.
