The Workplace Relations Commission found that the Irish Wheelchair Association discriminated against Patrick McInerney when his employment ended and ordered it to pay him €31,830. The decision was dated 13 January 2023.

McInerney said he was not made redundant when a colleague was, and claimed age discrimination. The association said he retired under the contractual retirement age of 66. His employment ended on 12 January 2021, the day before his 66th birthday.

The WRC found that the dismissal was related to age and that the association had not objectively justified it. It also noted that a colleague was made redundant and another transferred, while neither option was offered to McInerney because of his age. The €31,830 redress was for the effects of the discrimination.
