WRC awards Darren Keavney €600 for constructive dismissal

The Workplace Relations Commission found that Darren Keavney was constructively dismissed by International Windscreens Ireland Ltd t/a AAA Mobile Windscreens and awarded him €600 gross. The decision was dated 1 February 2022. Keavney, a glass technician, said unsafe working conditions, inadequate equipment and abusive treatment led him to resign. The company denied safety problems and said its van was roadworthy and its work practices met safety guidelines. The adjudication officer found no fundamental breach of contract, but concluded the employer's conduct was borderline unreasonable and that the constructive dismissal claim was proven, albeit marginally. Keavney had moved immediately to a much higher-paid job, so the award was equivalent to one week's wages.
