WRC rejects complainant’s disability discrimination claim over redundancy selection

By Gráinne Nolan

Historic decision · Decision date:

Place: no local area assigned from the source.

The Workplace Relations Commission rejected a complainant’s disability discrimination claim over her selection for redundancy by an aviation services company. In a decision dated 11 May 2022, the WRC found that she was not discriminated against. The complainant argued that working in one service area as an accommodation for her disability limited the skills she could demonstrate in the redundancy scoring. The company said it gave her average skills points to account for that restriction and retained some lower-scoring staff because their separate training was needed during the Covid disruption. The adjudication officer found that the company provided accommodation during the selection process and that the complainant received more favourable treatment than colleagues working in the same area. The officer was not satisfied that she had established facts from which discrimination could be inferred.
