The Workplace Relations Commission found Niall Walsh’s complaint that Go Safe denied him statutory rest breaks was not well founded. The decision, dated 1 March 2023, concerned his complaint under the Organisation of Working Time Act. Walsh said his monitoring schedule and duties made it difficult to take breaks while staying with his vehicle and equipment. Road Safety Operations Ireland Limited Go Safe said operators could take breaks in or leave their vehicles, and pointed to electronic and spreadsheet time records. The adjudication officer preferred the company’s evidence and found it had shown that the statutory break rules were not breached. The complaint was dismissed.
