The WRC found that Eimear Boushel-Payne was fairly made redundant by McCann Advertising Dublin Limited, rejecting her unfair dismissal complaint. The decision was dated 23 November 2021. Boushel-Payne said there was no genuine redundancy and argued that a later Senior Account Manager vacancy had similar duties to her role and should have been offered to her. The company said the pandemic downturn had sharply reduced its work and revenue, leading to five redundancies among 22 employees. The adjudication officer found the business downturn created a genuine redundancy, that Boushel-Payne was consulted and selected using fair criteria, and that the later vacancy arose after the redundancy decision. The officer also found it was not unreasonable for the company not to offer her the more senior role.
