The Workplace Relations Commission found Anthony Heaphy’s unfair dismissal and penalisation complaints against the Health Service Executive were brought outside the time limits and were not well founded; the merits were not decided. The decision was dated 13 April 2023. Heaphy said a toxic, understaffed environment led him to resign and that the HSE later penalised him after he made a protected disclosure. The HSE denied both claims. The Commission also recorded that Heaphy withdrew three other complaints during the hearing. The penalisation complaint was brought under section 55M(1) of the Health Act 2004.
