The Workplace Relations Commission awarded €7,500 to Darius Radu Peicu after finding that Ascot Catering Limited Ciao Bella Roma unfairly dismissed him. The WRC decision was dated 19 October 2023.
Peicu worked as a kitchen assistant and later in food preparation and as a driver at the restaurant, which closed in March 2020. He said he was not paid for his final two weeks, notice, annual leave or public holidays, and that he remained unemployed for a year after his dismissal.
The respondent did not attend the hearing. The adjudication officer accepted Peicu’s evidence and found all eight complaints well founded. The awards included €819 in unpaid wages, €819 in notice pay, €803.25 for public-holiday entitlements, €1,701 for annual leave, and €2,500 each for breaches of daily and weekly rest periods.
The WRC found the dismissal unfair and awarded €7,500. It also awarded €204.75 for Sunday premium. Rest-period awards compensate for breaches of the required time off between shifts and during the working week.
