The Workplace Relations Commission awarded Antonio Santoiemma €2,500 for breaches of daily rest periods and €1,795 for unfair dismissal by Ascot Catering Limited Ciao Bella Roma. Its decision was dated 19 October 2023.

Santoiemma worked as bar staff at the Dublin city-centre restaurant, earning €11 an hour. He said he was not paid for his final two weeks, notice, annual leave or public holidays. He was re-employed soon after his dismissal and told the WRC he had no losses attributable to it.

The respondent did not attend the hearing. The adjudication officer accepted Santoiemma’s evidence and upheld his complaints. Other awards were €514.80 for Sunday premium, €1,795.20 in notice pay, €772 for public holidays, €1,795 for annual leave and €899 in unpaid wages.

The WRC described the dismissal as unfair and set compensation at four weeks’ pay. The daily-rest award related to breaches of the required time off between shifts.
