The Workplace Relations Commission found Daiva Dabuzinskaite’s complaint against Ballsbridge Leisure Investment Ltd. t/a Intercontinental Dublin not well-founded. Her claim concerned unpaid annual leave and public-holiday entitlements when she resigned on 4 October 2020. The decision was dated 28 October 2022. Dabuzinskaite claimed €6,058.41 for annual leave and €1,908.16 for public holidays. The WRC found that she had been paid €5,397.98 gross for annual leave accrued in 2019/2020, and that no annual leave accrued during her temporary lay-off from 1 April to 4 October 2020. It also found she had been paid € 740.04 gross for five public holidays and a carryover balance of 1.2 days. The complaint failed because the statutory entitlements in the period considered had been paid.
