The Workplace Relations Commission ordered K & G Civil Engineering Ltd to reinstate Rory Branagan and pay the remuneration he would have earned since his dismissal, after finding that he was unfairly dismissed. The decision was dated 13 December 2021. Branagan said he was the only employee on temporary lay-off who was not brought back and that subcontractors had been re-engaged. The company said pandemic closures had reduced the number of available jobs. The adjudicator found there had been no consultation, no alternatives were explored and later available work was not offered to him. The WRC also awarded him €3,118 for the terms-of-employment complaint and €779.50 for one week’s notice.
