WRC rejects chef’s unfair dismissal complaint against bistro

The Workplace Relations Commission found Dumitru Petrica’s unfair dismissal complaint against Pizzeria La Scala Ltd. Trading as Maximilian’s Bistro was not well founded. Adjudication Officer Penelope McGrath’s decision was dated 24 November 2021. Petrica, who had worked as a chef for nearly five years, said he was unsure he was welcome back after taking leave and self-isolating, and found another job. The officer found that Petrica chose to leave after accepting work he considered too good to turn down, and that there had been no unfair dismissal.
