The WRC found that a financial services provider did not unfairly dismiss a former employee over conduct outside work. Adjudication Officer Anne McElduff dated the decision 30 August 2022.
The employer said it lost trust after the former employee admitted withdrawing about €40,000 from an older family friend’s credit union account and pleaded guilty in criminal proceedings. He argued that dismissal was disproportionate, citing his long service and willingness to move to a role without cash handling.
The WRC found that fair procedures had been followed overall, despite shortcomings at early meetings. It said the provider’s financial business required trust and confidence and that it was not obliged to create a different role for him. The complaint was not well founded.
