The Workplace Relations Commission found Gireesh Palickal Rajasekharan Nair’s discrimination complaint against Beechwood House Nursing Home not well founded. The decision was dated 11 May 2022. Nair, who worked as a chef, alleged that the home discriminated against him on race and family-status grounds after his wife declined an offer of a nursing job there. He said his treatment changed after she refused the offer and that he was dismissed. The home said it acted on infection-control concerns because Nair and his wife worked in separate nursing homes, and denied terminating his employment. The WRC found Nair had not identified a comparator and had provided no evidence from which race discrimination could be inferred. It accepted that the home followed advice from authorities to safeguard residents and staff, and concluded its actions were not discriminatory.
