The Workplace Relations Commission found Thomas Murphy’s constructive dismissal complaint against Kilsaran Concrete Unlimited Company not well founded in a decision dated 18 February 2022. Murphy said he was forced to resign after a colleague’s aggressive behaviour and management’s response. The adjudication officer found that management had failed to investigate the colleague’s behaviour, but that its efforts to support Murphy did not make his resignation justified. Murphy also complained that he worked more than 48 hours a week. The WRC found that the complaint was brought outside the time limit and was not well founded; the merits were not decided. Records showed an average of 45.25 hours a week between January and June 2019.
