WRC rejects Sean Byrne’s unfair dismissal and notice complaints against Actavo

The WRC found Sean Byrne was not unfairly dismissed by Actavo Industrial Solutions (Ireland) Limited and was not entitled to notice pay. The decision was dated 4 May 2022. Byrne said he felt he had no option but to resign after a safety incident and alleged he was denied representation at a meeting. The employer said it was investigating the incident and intended to suspend him on paid leave, but he resigned before receiving the suspension letter. The adjudication officer preferred the employer’s account and found Byrne resigned without exploring the options available to him.
