The Workplace Relations Commission found John Gray’s unfair dismissal complaint well founded and ordered Shannon Transport & Warehouse Company T/A STL Logistics to pay him €8,000 compensation. The decision was dated 20 April 2023.

Gray had almost 25 years’ service as a driver when he was dismissed for gross misconduct after making one unscheduled, undocumented delivery of a keg to the Bridge Tavern. The company said the dismissal was justified; Gray argued that the delivery was part of an established swop practice and challenged the disciplinary process.

The adjudication officer found the employer had not given evidence at the hearing and had failed to show the dismissal was reasonable. The officer also found the delivery did not amount to gross misconduct and dismissal was disproportionate for an employee with almost 25 years’ service. Compensation was ordered for the unfair dismissal. Gray’s separate Payment of Wages complaint was withdrawn.
