WRC finds Traveller accommodation complaint out of time

The Workplace Relations Commission found a Traveller’s discrimination and harassment complaint against a local authority was out of time and statute-barred. The decision was dated 10 August 2023; the merits were not decided. The complaint concerned accommodation needs and safety issues at a family caravan. The council was accepted as the correct respondent because it was responsible for its employees’ actions. The complaint was lodged in June 2018, after an ES1 notification in February 2016, and no exceptional circumstances were advanced to dispense with the notification requirements.
