A worker lost five complaints after the WRC found his dismissal for gross misconduct was reasonable and proportionate. The decision, dated 27 April 2018, also found that he was not entitled to notice and had received payment for holidays not taken. The worker had been employed as a general operative and fork-truck driver by a family-owned wholesale cash and carry business. The dispute followed an altercation in which he injured a colleague. He argued that the dismissal was unfair and that the employer’s investigation was flawed. The WRC found that the use of CCTV introduced a flaw in the process, but did not make it unfair. The complaints concerned unfair dismissal, payment of wages, minimum notice and holiday pay. The WRC found the dismissal fair, ruled that gross misconduct meant he was not entitled to notice, and found he had been paid for holidays not taken. All five complaints failed.
