WRC awards healthcare assistant €12,720 for unfair dismissal

By Gráinne Nolan

Workplace Relations Commission ·

The Workplace Relations Commission found that a healthcare provider unfairly dismissed a healthcare assistant and directed it to pay €12,720 in compensation. The decision was dated 10 April 2018.

The worker said she was retired on ill-health grounds without being told that a meeting could end her employment. She said she was not represented at the meeting and had no right of appeal. The employer said it could not redeploy her or safely continue her restricted duties.

The WRC found that the worker was not consulted about alternatives, was not warned of the meeting’s serious consequences and was not allowed to appeal. It also found the meeting should have been postponed until her union representative could attend. The officer recommended compensation as the remedy and directed the employer to pay €12,720.
