The Workplace Relations Commission dismissed Olumide Smith’s complaint alleging race discrimination and harassment against the WRC, finding it had no jurisdiction to investigate it. The decision was dated 3 December 2021.
The WRC found its adjudicator’s decision-making functions were quasi-judicial and did not constitute a service under the Equal Status Act. It also found that vicarious liability could not attach to the commission in these circumstances; the merits of Smith’s allegations were not decided.
