WRC rejects warehouse operative’s unfair dismissal complaint

By Eimear Byrne

Workplace Relations Commission ·

The Workplace Relations Commission found that a warehouse operative’s unfair-dismissal complaint was not well founded, in a decision dated 16 March 2017. The worker said he had travelled to Lithuania for dental treatment he could not afford in Ireland and was dismissed after taking sick leave. The employer said the worker had been warned that his absence would be treated seriously and had not contacted the company when his medical certificate expired. The adjudication officer found that the worker knowingly breached the absence policy and failed to tell the employer how long he would be away.
